These Booking Terms and Conditions (“Booking Terms”) govern reservations, booking requests, payments, cancellations, stays and related accommodation services booked through Lodgiko.
Lodgiko is an online accommodation discovery, reservation and marketplace platform operated and/or supported by Merahkie International Private Limited, India, and Merahkie Silk Road, Uzbekistan, together with their applicable affiliates, divisions, representatives, technology providers and service partners (collectively referred to, where appropriate, as “Lodgiko,” “we,” “us,” or “our”).
By making or requesting a reservation through Lodgiko, you (“Guest,” “Customer,” “User,” or “you”) acknowledge that you have read, understood and agreed to these Booking Terms, together with any property-specific conditions, cancellation policies, payment terms, Privacy Policy, Website Terms of Use and other conditions displayed during the booking process.
1. Role of Lodgiko
Lodgiko provides a technology and marketplace platform through which hotels, guest houses, hostels, apartments, resorts, homestays, property owners, operators, managers, and other accommodation providers (“Accommodation Providers”) may advertise and offer accommodation and related services to travelers.
Unless expressly stated otherwise for a particular service, Lodgiko is not the owner, operator, manager, landlord, or direct provider of accommodation booked through the platform. When a reservation is confirmed, the contract for the actual provision of accommodation and property-level services is generally between the Guest and the applicable Accommodation Provider, subject to applicable law and the specific contractual arrangement disclosed during booking.
Lodgiko acts primarily as an intermediary, marketplace, technology provider, reservation facilitator, marketing platform, and/or payment facilitator, as applicable. Nothing in these Booking Terms excludes any responsibility that Lodgiko or another party is legally prohibited from excluding under applicable law.
2. Accommodation Provider Responsibilities
Each Accommodation Provider is responsible for the accommodation and services it offers, including the accuracy of property and room information; lawful operation and required licenses, registrations, permits and approvals; availability and inventory; room categories and occupancy; rates, taxes, fees and charges supplied to Lodgiko; photographs and descriptions supplied by the provider; amenities and facilities; cleanliness, maintenance, safety and security; check-in and check-out; guest registration; fulfillment of confirmed reservations; property-specific policies; refunds for which the Accommodation Provider is legally or contractually responsible; and compliance with applicable hospitality, tourism, consumer, safety, tax, registration and other laws.
Accommodation Providers are independent businesses unless Lodgiko expressly identifies a particular property as being owned, leased or directly operated by a Lodgiko-affiliated entity.
3. Accuracy of Listings
Lodgiko seeks to provide accurate and useful accommodation information. However, much of the information displayed on the platform may be provided or updated by Accommodation Providers or third-party systems.
Photographs are generally illustrative of the property or room category. The precise room allocated may differ in furnishings, layout, view, decoration, dimensions or other non-material characteristics unless a particular feature has been expressly guaranteed in the confirmed reservation. Distances, maps, star classifications, descriptions, amenities, availability and other information may change. Lodgiko may correct obvious errors or outdated information when discovered.
4. Making a Reservation
Guests must provide accurate, complete and current information when making a reservation, including where required their full legal name, contact information, nationality or residency information, number and ages of guests, arrival and departure dates, payment information and other information reasonably required to process or fulfill the reservation.
The person making the reservation must be at least 18 years old unless a higher minimum age is required by the Accommodation Provider or applicable law. The booking person is responsible for ensuring that all persons included in the reservation understand and comply with the applicable Booking Terms and property policies.
5. Booking Confirmation
A reservation is not necessarily confirmed merely because a booking request has been submitted. Depending on the property, Lodgiko may offer Instant Confirmation, where the reservation becomes confirmed when the platform issues a valid booking confirmation, or Request to Book, where the reservation remains subject to availability and confirmation by the Accommodation Provider and/or Lodgiko.
Guests should not assume that a booking is confirmed until they receive an official confirmation through Lodgiko or another authorized confirmation channel. Guests are responsible for reviewing the confirmation immediately and reporting material errors promptly.
6. Rates, Taxes and Charges
The price displayed during booking will specify, where reasonably practicable, what is included in the quoted amount. Depending on the property and applicable regulations, additional charges may include tourism or city taxes, government fees, VAT or other taxes, registration charges, resort or service fees, breakfast, extra beds, additional guests, parking, airport transfers, minibar, incidental expenses or optional services.
Some charges may be payable directly to the Accommodation Provider. The Guest is responsible for reviewing the final booking summary and applicable price conditions before confirming a reservation.
7. Obvious Pricing and System Errors
Lodgiko and Accommodation Providers reserve the right, subject to applicable law, to correct genuine and obvious pricing, availability, currency-conversion, technical, typographical, synchronization or system errors.
If a material error affects a reservation, the Guest may be offered the opportunity to accept corrected terms or receive an appropriate cancellation or refund where required. This provision does not permit arbitrary price changes after a valid booking merely because a property later wishes to charge a higher rate.
8. Currency Conversion
Currency conversions displayed by Lodgiko may be provided for convenience. Exchange rates fluctuate, and the actual amount charged may differ due to payment processor conversion rates, card issuer rates, bank fees, international transaction fees or the currency in which the Accommodation Provider processes payment. Unless expressly guaranteed, displayed converted amounts are estimates.
9. Payments
Depending on the reservation, payment may be made fully online, partially prepaid, secured by a deposit, authorized or guaranteed using a payment method, collected by Lodgiko or an authorized payment processor, collected by the Accommodation Provider, or payable at the property.
The payment conditions displayed for the selected rate form part of the booking. Lodgiko may use third-party payment processors and financial institutions. Guests must use a valid and authorized payment method. Lodgiko may cancel, suspend or request verification of transactions reasonably suspected of fraud, unauthorized payment activity, sanctions violations, abuse or other unlawful conduct, subject to applicable law.
10. Cancellation Policy
Cancellation policies vary by property and rate plan. The cancellation policy displayed during booking and included in the booking confirmation forms an integral part of the reservation.
A reservation may be fully refundable, partially refundable, non-refundable, or subject to cancellation penalties based on the cancellation date. Guests must review the applicable cancellation policy before booking. Where a booking is non-refundable, cancellation may result in the Guest being charged up to the full reservation amount, subject to applicable law.
11. Modification of Reservations
Requests to change dates, room type, guest names, number of guests, meal plans or other reservation details are subject to availability, rate differences, property policies and applicable fees. A requested modification is not effective until confirmed. Changing reservation dates may result in a different price because accommodation rates can vary by date and availability.
12. No-Show and Late Arrival
A Guest who does not arrive on the scheduled check-in date without properly notifying the Accommodation Provider or Lodgiko may be considered a no-show. The property may charge applicable no-show fees and may release the room for resale according to the booking conditions and applicable law.
Guests expecting to arrive late should contact the property in advance. Lodgiko cannot guarantee that a property will hold accommodation indefinitely where the Guest fails to arrive or communicate.
13. Early Departure
If a Guest leaves before the confirmed departure date, unused nights may be non-refundable depending on the selected rate, property policy, contractual terms and applicable law. Guests should confirm early-departure conditions with the property before leaving.
14. Check-In Requirements
Accommodation Providers may require Guests to present a passport, national identification, visa or immigration documentation where applicable, booking confirmation, payment card, security deposit or other documents required by law.
Guests are responsible for possessing valid travel and identification documents. Lodgiko is not responsible for a Guest being refused check-in because the Guest lacks legally required documentation, violates lawful property policies, fails to meet booking conditions or provides materially false booking information.
15. Uzbekistan Registration and Travel Requirements
Guests traveling to or within Uzbekistan are responsible for understanding and complying with applicable passport, visa, immigration, temporary registration, customs and other governmental requirements.
Where an Accommodation Provider is legally required to perform guest registration or related formalities, responsibility for performing those property-level obligations rests with the Accommodation Provider. Requirements may vary according to nationality, residency status, visa type and changes in law.
16. Children, Additional Guests and Extra Beds
Children and extra-guest policies vary by property. Guests must accurately declare the number and ages of persons staying. A property may refuse occupancy beyond its legally or operationally permitted capacity. Charges may apply for children, extra beds, cribs, additional adults or additional rooms. These conditions should be reviewed before booking.
17. Special Requests
Requests such as early check-in, late check-out, adjoining rooms, specific floors, particular views, accessibility arrangements, dietary requests, airport transfers or specific bed configurations are subject to availability unless expressly confirmed as guaranteed. Submitting a special request does not itself constitute confirmation.
18. Property Rules and Guest Conduct
Guests must comply with reasonable and lawful property rules concerning smoking, noise, visitors, pets, use of facilities, prohibited substances, illegal activities, fire and safety regulations and protection of property.
The Accommodation Provider may take reasonable action, including terminating a stay where legally permitted, if a Guest engages in serious misconduct, unlawful activity, violence, threats, harassment, intentional property damage or conduct that materially endangers others. No refund is guaranteed where accommodation is lawfully terminated because of serious Guest misconduct.
19. Damage to Property
Guests may be responsible for damage, loss, excessive cleaning or other costs caused intentionally or negligently by the Guest or persons for whom the Guest is responsible, subject to applicable law and evidence of the claimed loss. Accommodation Providers may require a security deposit. Any damage charge should be reasonably supported and handled according to applicable law and the property’s disclosed terms.
20. Safety, Security and Personal Belongings
Guests should take reasonable precautions regarding personal safety and belongings. Accommodation Providers are primarily responsible for maintaining their premises and complying with applicable property-level safety requirements. Lodgiko does not control the day-to-day physical operation of independently operated properties.
Liability for lost, stolen or damaged belongings is determined by the circumstances, applicable property terms, insurance and applicable law. Nothing in these Terms excludes liability that cannot legally be excluded.
21. Property Unable to Honor a Confirmed Reservation
Occasionally, an Accommodation Provider may be unable to honor a reservation because of overbooking, emergency maintenance, safety issues, government action, closure, inventory synchronization errors or events beyond reasonable control.
Where a confirmed reservation cannot be honored, the responsible parties will use commercially reasonable efforts, as applicable, to assist with an appropriate solution, which may include alternative accommodation, changed dates, or cancellation and an applicable refund. The precise remedy depends on the circumstances, who collected the payment, contractual arrangements and applicable law. An Accommodation Provider may be responsible for costs arising from its own wrongful failure to honor a confirmed booking where required by its agreement with Lodgiko or applicable law.
22. Refunds
Refund eligibility depends on the cancellation policy, selected rate, reason for cancellation, payment method, property policy, contractual obligations and applicable law. Where Lodgiko collected payment as an intermediary, Lodgiko may process an authorized refund through the original payment method.
Processing times may depend on banks, card networks, payment processors and financial institutions outside Lodgiko’s direct control. A refund being authorized does not necessarily mean it will immediately appear in the Guest’s account.
23. Complaints During the Stay
Guests should report material accommodation problems as soon as reasonably possible while at the property, giving the Accommodation Provider a reasonable opportunity to investigate and, where appropriate, correct the problem. Where necessary, the Guest should also contact Lodgiko.
Guests should retain relevant evidence, such as photographs, correspondence, receipts and booking documents. Failure to report a readily remediable issue during the stay may affect the practical ability to investigate or resolve a later complaint, but does not waive rights that cannot legally be waived.
24. Reviews and User Content
Guests may be invited to submit reviews, ratings, photographs or other content. Reviews must reflect genuine experiences and must not contain knowingly false statements, unlawful content, threats, hate speech, harassment, confidential personal information, fraudulent reviews, undisclosed paid manipulation or content infringing third-party rights.
Lodgiko may moderate or remove content that violates platform policies or applicable law. Lodgiko does not guarantee that every opinion expressed in a user review is accurate.
25. Third-Party Services
Properties may offer or arrange third-party services such as transportation, tours, guides, car rentals, activities, restaurants, spa services or excursions. Unless expressly stated otherwise, independent third-party providers are responsible for the services they provide, and separate terms may apply.
26. Force Majeure and Events Beyond Reasonable Control
To the extent permitted by applicable law, Lodgiko and/or Accommodation Providers shall not be responsible for failure or delay caused by circumstances genuinely beyond their reasonable control, which may include natural disasters, earthquakes, floods, severe weather, fire, epidemics or pandemics, war, terrorism, civil unrest, government restrictions, border closures, widespread transportation disruption, major utility failures, telecommunications outages or comparable extraordinary events.
Refunds, rebooking, credits or other remedies in such circumstances will be determined according to applicable law, booking conditions, property policies and mandatory consumer protections.
27. Lodgiko’s Liability
To the maximum extent permitted by applicable law, Lodgiko is responsible for its own obligations in connection with the platform and services it directly provides. However, where Lodgiko acts solely as an intermediary, Lodgiko is not responsible for the independent acts or omissions of an Accommodation Provider or unrelated third-party provider, except where liability is imposed on Lodgiko by applicable law or arises from Lodgiko’s own wrongful conduct.
To the maximum extent legally permitted, Lodgiko shall not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, including loss of profit, opportunity, goodwill or anticipated savings, arising from use of the platform or a booking. Any contractual limitation of liability applies only to the extent enforceable under applicable law.
Nothing in these Booking Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot legally be excluded, or any other liability or consumer right that applicable law prohibits from being excluded or limited.
28. Protection of Lodgiko-Affiliated Entities
Where legally applicable, references to Lodgiko in limitations, protections, indemnities and disclaimers include Merahkie International Private Limited, India; Merahkie Silk Road, Uzbekistan; and their applicable parent entities, subsidiaries, affiliates, directors, officers, employees, representatives, contractors, technology providers and agents.
Each legal entity remains responsible for obligations legally attributable to that entity, and nothing in these Terms is intended to create an artificial exclusion of mandatory statutory liability.
29. Accommodation Provider Protection
Nothing in these Booking Terms makes an Accommodation Provider liable for matters caused solely by Lodgiko’s own wrongful conduct. Likewise, Lodgiko is not automatically responsible for matters caused solely by an independently operated Accommodation Provider.
Accommodation Providers retain the benefit of reasonable property rules, cancellation conditions, no-show provisions, damage policies and other booking conditions disclosed to the Guest, subject always to applicable law.
30. Guest Indemnification
To the extent permitted by applicable law, a User agrees to indemnify and hold harmless Lodgiko and affected Accommodation Providers against third-party claims, losses, liabilities and reasonable costs arising directly from the User’s fraudulent conduct, intentional unlawful acts, material breach of these Booking Terms, intentional property damage or infringement of third-party rights.
This provision does not require a consumer to indemnify Lodgiko or an Accommodation Provider for that party’s own negligence, misconduct, breach of law or obligations that cannot legally be transferred to the consumer.
31. Fraud, Abuse and Reservation Cancellation
Lodgiko may investigate and, where reasonably justified, suspend, reject or cancel bookings associated with suspected payment fraud, stolen payment instruments, false identities, unauthorized resale, fraudulent chargebacks, sanctions violations, unlawful activity, manipulation of promotional offers, cybersecurity attacks or serious abuse of the platform. Any action will be taken subject to applicable law and legitimate consumer rights.
32. Chargebacks and Payment Disputes
Guests should first contact Lodgiko and/or the Accommodation Provider regarding legitimate billing disputes so the matter can be investigated. Nothing in these Terms prevents a Guest from exercising lawful rights to dispute an unauthorized or improper transaction through a bank, card issuer, payment provider, regulator or court.
Knowingly filing a false or fraudulent chargeback may constitute a breach of these Terms and may result in account restrictions or lawful recovery action.
33. Personal Data
Booking accommodation requires the processing and sharing of certain personal information. Information may need to be shared with the booked Accommodation Provider, payment processors, technology providers, customer-support providers, governmental or regulatory authorities where legally required, and other parties necessary to process or fulfill the reservation.
Personal data will be processed according to the applicable Lodgiko Privacy Policy and applicable law. Lodgiko should maintain a separate, detailed Privacy and Cookie Policy addressing applicable data-protection requirements.
34. Electronic Communications
By making a booking, Users agree that transactional communications relating to the reservation may be sent electronically, including through email, SMS, WhatsApp or similar messaging services where authorized, account notifications or other contact methods supplied by the User.
Transactional booking communications are distinct from promotional marketing. Marketing communications will be handled according to applicable consent requirements and the Privacy Policy.
35. Intellectual Property
The Lodgiko name, branding, platform design, proprietary software, original text, databases and other protected materials are owned by or licensed to the applicable Lodgiko entity. Hotel names, trademarks, photographs and content supplied by Accommodation Providers may belong to those respective providers or licensors.
Users may not scrape, systematically extract, reproduce, republish, commercially exploit or misuse protected platform content except as permitted by law or written authorization.
36. Governing Law and Dispute Resolution
Because Lodgiko may involve an Indian parent company, an Uzbekistan operating entity, Uzbekistan Accommodation Providers and international Guests, governing law and jurisdiction may depend on the entity providing the relevant service, the location of the accommodation, mandatory consumer law and the nature of the dispute.
Unless mandatory law requires otherwise, disputes directly concerning the physical provision of accommodation may be subject to the laws and competent authorities applicable where the Accommodation Provider operates. Disputes concerning services directly contracted with a specific Lodgiko legal entity may be governed by the law and jurisdiction specified in the applicable transaction, corporate terms or agreement.
Nothing in these Booking Terms deprives a consumer of mandatory rights or access to a competent court or regulatory remedy that cannot lawfully be waived by contract.
37. Changes to These Booking Terms
Lodgiko may update these Booking Terms periodically for operational, commercial, regulatory, security or legal reasons. The version applicable to a reservation will generally be the version in effect when the reservation was made, except where a change is required by law or expressly agreed by the parties. Material changes will not retroactively remove vested contractual or statutory rights where prohibited by law.
38. Severability
If any provision of these Booking Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary, where legally permissible, and the remaining provisions shall continue in effect.
39. No Waiver
Failure by Lodgiko or an Accommodation Provider to immediately enforce a contractual right does not automatically constitute a permanent waiver of that right.
40. Entire Booking Agreement
The applicable contractual framework for a reservation may consist of these Booking Terms, the booking confirmation, selected rate conditions, cancellation policy, property-specific rules, applicable payment conditions, Privacy Policy and Terms of Use where relevant.
If a property-specific booking condition conflicts with these general Booking Terms, the more specific condition generally governs the relevant booking issue, except where prohibited by applicable law.
41. Contact and Legal Entity Information
Lodgiko is an online accommodation booking and travel marketplace operated and/or supported, as applicable, by Merahkie International Private Limited, India, and Merahkie Silk Road, Uzbekistan.
Official contact details, registered addresses, company registration information, tax details and customer-support information should be displayed on Lodgiko’s Contact and Legal Information pages as applicable.
Important Booking Notice
Lodgiko is primarily an accommodation booking marketplace and intermediary. Unless expressly stated otherwise, accommodation services are provided by independent hotels and Accommodation Providers. Each property has its own cancellation, payment, check-in and house policies. Always review the specific conditions displayed before completing your reservation.
Acceptance
By clicking “Book,” “Reserve,” “Confirm Booking,” “Pay,” or an equivalent button, or by otherwise completing a reservation through Lodgiko, you acknowledge that you have reviewed and accepted the applicable Booking Terms and Conditions, cancellation policy, payment terms, property-specific conditions and Privacy Policy.
